SETANTA COLLEGE TERMS & CONDITIONS (UPDATED 28/01/21)

1.1 Full payment of the first module of the course must be made or a monthly payment plan put in place before the course commences.

1.2 Fee refunds are not given to any student who has accessed course content or for any student who commences a course and subsequently feels that the course does not suit him/her.

1.3 Once a student completes one module he/she will not receive access to the next module until the next module is paid in full.

1.4 The module fee is non-refundable once a module has commenced and non-transferable once payment has been issued. This does not affect your rights regarding the 14 day cooling off period as our course delivery falls under the ‘Online Digital Content’ exemption.

1.5 Setanta College reserves the right to charge a late payment fee on overdue accounts.
Setanta College reserves the right to withhold services to any student for non-payment of fees or other amounts due.

1.6 Course prices are subject to change and Setanta College reserves the right to charge additional amounts to reflect any pricing changes taking effect before the commencement of the next module.

1.7 Course commencement is dependent on student demand and course fees will not be refunded once a course has commenced.

1.8 Setanta College requires any student wishing to cancel his/her course to provide written notification of this cancellation. A student will receive a full refund minus an administration fee of €180 if notice of cancellation is given prior to course commencing.
Setanta College requires 30 days’ notice when a student is not completing his/her chosen course. Failure to do so will result in an administration fee of €75.

1.9 A fee of €75 will be applied to all students repeating a module or

1.10 For students who are having their fees paid by a third party, it is the participant’s responsibility to liaise with these bodies and to furnish our college a letter of approval of fees prior to commencement of the course and to request any necessary documentation from Setanta College.

1.11 The College reserve the right to apply additional charges as it sees fit in line with bank/card charges.(Please take note of this when choosing your payment plan)

1.12 Learners not put forward for certification until all programme fees paid in full

Optional programme deposit of €500/$560 if paid is deducted from the overall programme fees. This deposit is non-refundable.

The average cost per module is €1,500/$2,250. Once the first module/course has commenced €1,500/$2,250 of the programme fee is non-refundable if a student withdraws or terminates their programme of study.

Once enrolled on subsequent modules, a refund cannot be given for that module.

Setanta College requires 30 days’ notice when a student is not completing his/her chosen programme. Failure to do so will result in an administration fee of €75/$85.

A fee of €180/$200 will be applied to all students repeating a module/course in the Master of Science programme.

Learners who are granted a deferral and subsequently do not recommence their studies are not entitled to a refund of fees paid.

By accepting the Terms and Conditions for using our online application system, you confirm that Setanta College can share your contact details with Irish American University the Middle States Commission on Higher Education and other relevant government agencies.

This information will normally only be used by Setanta College to contact you in relation to education and training opportunities and for registering for certification with accrediting bodies. This information will not be shared with any other third party, except in the exceptional cases outlined above.

3.1 Introduction

At Setanta College, we treat your privacy seriously. Any personal data (i.e. information that can be used to identify you as an individual) which you provide to the College will be treated with the highest standards of security and confidentiality, in accordance with Irish and European Data Protection legislation and the College’s Data Protection Policy. This notice explains how the College collects, uses and shares personal data relating to prospective, current and former students of Setanta College (“you”). It also explains your rights under data protection law in relation to our processing of your data.

3.2 Who We Are

Throughout this Notice, “we”, “us”, “our” and “the College” refers to Setanta College.

3.3 How We Collect Your Personal Data

The personal data that the College holds about you is generally collected directly from you but some information may also be received from third parties including:

  • Other third level institutions (e.g., where you are transferring from those bodies to Setanta College, where you are a visiting student, where you are applying for a postgraduate course or where you are participating in a joint programme (e.g., with Irish American College));
  • Health and other professional bodies;
  • Linked education providers;
  • Agents and recruiters.

3.4 How We Use Your Personal Data

The College processes personal data relating to its students for administrative and other purposes necessary for the management and functioning of the College. Primarily, the College processes your personal data during the course of your application, admission and registration, for assessment/examinations, fee collection, IT administration and library administration, on your graduation and at the end of your studies for archival and alumni relations purposes (upon graduation, the Student Records & Examinations department will automatically transfer your student record to the College’s Development and Alumni department). This data may, in some cases, include “special categories of data” (as defined in the Data Protection Acts) where it is necessary for the College to collect and process such data.

The College also processes your personal data for the following purposes:

  • SMS text messaging system: The College operates an SMS text messaging system which gives certain College departments the option to communicate with students quickly and comprehensively. As a registered student, you will be automatically added to the list to receive texts regarding College related information. This may include, for example, notification of cancelled workshops, reminders relating to you logging into the online learning portal, details regarding your parchment fees, reminders about outstanding fees. If you do not wish to receive text alerts from us, you can opt out of this. Regardless of the foregoing, the College will send a text message in the event of an emergency.
  • Publication and acknowledgement of awards: Unless you ask us not to, students and graduates’ names and awards are publicly acknowledged at College ceremonies and published in conferring booklets and other College publications.
  • To administer the awarding of scholarships and prizes.
  • To support discounted course fees.
  • Photographs/video recordings of College events: The College may take photographs and video recordings of College events such as conferring ceremonies. Such images/recordings may include individual or group shots which may be published or included in video/broadcasts on the College’s website. The College will seek to give advance notice of this whenever possible by, for example, making announcements, placing visible notices in the relevant area or advertising on College notice boards so that those who do not want to participate can avoid being recorded and avoid the area(s) if they wish. In addition, where the College wishes to process images featuring students for promotional purposes, the consent of the students involved will be sought in advance.
  • Workshop capture system: The College operates a workshop capture system which enables tutors/videographers to record video, audio and presentation material from their workshops as well as audio of questions from students/attendees. The College will seek to give workshop attendees advance notice of any such recording by placing visible notices in the relevant areas and making oral announcements at the start of the lecture.
  • To manage insurance/personal accident claims;
  • To ensure that the digital services provided by the College are performant, reliable, secure and to support appropriate IT incident resolution;
  • The administration of examination appeals and the mitigation process;
  • To administer appeals, complaints, grievances, disciplinary matters and matters relating to conduct and suspected breach of examination regulations/plagiarism;
  • To communicate with you where necessary and to provide communications about College news and events;
  • To provide wellbeing and support services, including disability support services (where you choose to access disability services, your consent will be sought before we process personal data relating to your disability);
  • To meet health and safety obligations;

3.5 Our Legal Basis For Using Your Personal Data

Under data protection law, we are required to ensure that there is an appropriate legal basis for the processing of your personal data, and to let you know what that basis is.

We process your personal data for the purposes outlined in this notice in pursuit of our legitimate interests in managing the College and providing you with the education and support services required during the course of your studies.

Whilst we rely on legitimate interest as the legal basis for processing where this is not overridden by the interests and rights or freedoms of the data subjects concerned, we recognise that it is not the only lawful ground for processing data. As such, where appropriate, we will sometimes process your data on an alternative legal basis – for example, because you have given us consent to do so.

3.6 Personal Data Provided By You About Others

You may provide us with personal data about other individuals, for example, next of kin/emergency contact details and information about your family circumstances and dependents. You should notify the relevant person that you are providing their contact details to us.

3.7 Who We Share Your Personal Data With

In addition to cases where the College is required or permitted by law to disclose your personal data to others, the College may disclose your personal data in connection with the purposes referred to above. These include, but are not limited to:

  • Quality Qualifications Ireland
  • Higher Education Colleges Association
  • Funding bodies, research sponsors, industry funders and other agencies that support, sponsor or otherwise have a valid interest in your education
  • The Higher Education Authority (HEA) (see the HEA’s Student Collection Notice http://hea.ie/about-us/data_protection/)
  • Distance Education Accrediting Commission – United States (DEAC)
  • Commission for Independent Education – Florida (CIE) – Florida
  • Quality Council for Trades and Occupations – South Africa (QCTO)
  • Register of Exercise Professionals Ireland (REPs Ireland)
  • National Forum for teaching and learning
  • Providers of academic and other services to the College(who are obliged to keep your data safe and secure), which may also include, but is not limited to, wholly/majority owned subsidiaries of the College
  • Examination Boards and External Examiners
  • Government departments where required (e.g. Department of Education and Skills, Department of Employment Affairs and Social Protection, Revenue)
  • Potential employers (where you have requested us to provide a reference)
  • The College’s insurance brokers and providers where required for administering claims
  • Professional and regulatory bodies where programmes are accredited by such bodies
  • External auditors
  • Other higher education institutions, partners or research organisations to or from which a student transfers or pursues an exchange programme or where a student’s programme is being run collaboratively

Where we use third parties to process personal data on our behalf (acting as data processors), a written contract will be put in place to ensure that any personal data shared will be held in accordance with the requirements of data protection law and that such data processors have appropriate security measures in place in relation to your personal data.

The College sometimes needs to communicate and share personal data worldwide in the course of its business and transfers personal data to countries outside the European Economic area. The College will only do so on the understanding that we rely on legally approved mechanisms to lawfully transfer data across borders, including the Standard Contractual Clauses approved by the European Commission.

The College may share your personal data between different internal departments for operational reasons where necessary and proportionate for the purposes intended. Some of the personal data that the College holds, such as health details, is known as ‘special category data’ or ‘sensitive personal data’. In addition to the normal standards of confidentiality, we carefully control access to sensitive personal data within the College so that it is only available to those staff who require it to perform their duties.

3.8 How Long We Will Keep Your Data

In keeping with the data protection principles we will only store your data for as long as is necessary. For the purposes described here we will store your data in accordance with the College’s Record Retention Schedules.

3.9 Keeping Your Data Up-To-Date

The Data Protection Acts require that personal data about individuals is accurate and kept up-to-date. It is important therefore that you update your personal details regularly (e.g., your postal address, mobile phone number). 3.10 Your Rights

You have various rights under data protection law, subject to certain exemptions, in connection with our processing of your personal data, including the right:

  • to find out if we use your personal data, to access your personal data and to receive copies of your personal data.
  • to have inaccurate/incomplete information corrected and updated;
  • in certain circumstances, to have your details deleted from systems that we use to process your personal data or have the use of your personal data restricted in certain ways;
  • to object to certain processing of your data by Setanta College;
  • to exercise your right to data portability where applicable (i.e. obtain a copy of your personal data in a commonly used electronic form);
  • where we have relied upon consent as a lawful basis for processing, to withdraw your consent to the processing at any time;
  • to not be subject to solely automated decision;
  • to request that we stop sending you direct marketing communications.

3.13 Use of Images

Learners accept that Setanta College may use their image and personal identifiers for the purposes of programme administration (e.g., Moodle profile picture, student card, photo-board for lecturers, etc.), information sharing and promotion of Setanta College.

4.1 For the purposes of this section, “Intellectual Property Rights” shall mean patents, trademarks and service marks, rights in designs, trade, business or domain names, database rights, confidential information and/or trade secrets, copyright and any other rights relating to documents and materials for programmes of education and related rights (including but not limited to rights in computer software) whether or not registered and including applications for (and the right to apply for) registration of any such thing and all rights or forms of protection of a similar nature or having equivalent or similar effect to any of these which may subsist anywhere in the world for the full period thereof and all extensions or renewals thereof.

4.2 Setanta College shall exclusively own all Intellectual Property Rights in connection with any programme materials (whether hard copy, online or otherwise) and learners shall not use or disclose any programme materials except for the purposes of completing the relevant programme of study.

In the interest of public safety, learners understand that they have a legal, ethical and moral obligation to disclose any information, at the earliest opportunity, which may have relevance to their ability to work in a coaching environment.

Setanta College reserves the right to refuse admission onto a course if a candidate is not suitable to undertake a programme of study.

All applicants are required to disclose any relevant conviction when applying to the college. If information relating to offences is not given or is given in incomplete form, then Setanta college reserves the right at any stage (including after an offer of a place has been made, or after registration) to reject the application.

A relevant Criminal Conviction is:

(a) Any conviction in Ireland or abroad for an offence against the person, whether of a violent or a sexual nature (whether or not a custodial sentence was imposed in respect of such conviction); or

(b) Any conviction in Ireland or abroad for an offence involving unlawfully supplying controlled drugs or substances where the conviction concerns commercial drug dealing or trafficking (whether or not a custodial sentence was imposed in respect of such conviction).

Where an applicant has declared or disclosed a relevant conviction to the college, the applicants case will be considered initially by the college management and the relevant academic staff. If the applicant’s case is straightforward it may be decided at that stage that an offer will not be refused because of the relevant conviction.

6.1 Setanta College utilises continuous assessment whereby learners must demonstrate their knowledge, competence and skills in the relevant programme areas.

6.2. Progression from one stage of the programme to the next is dependent on the learner achieving at least a pass grade in the practical/skills based assessment for each module that has that particular type of assessment component.

6.3. Learners must complete each module on their programme. Failure to submit the necessary assessments will result in failure of the module.

6.4. The assessment must be repeated (and capped at Pass) if learning outcomes are not demonstrated at first attempt, or a ‘resubmit’ is required. Learners have three attempts to pass the module (except in the case of the dissertation, where only one attempt is possible).

6.5. According to QQI’s Assessment and Standards (Revised 2013), “Honours classification, or any classification higher than ‘pass’, shall be made on first attempt grades only.” This means that any learner who does not pass an award stage module at the first attempt can only be awarded a Pass overall.

6.6. All assessment requirements must be completed and submitted to Moodle by the specified deadlines.

7.1 In consideration of being allowed to participate in the activities of Setanta College which are undertaken by the selected insured tutors and to use the facilities and equipment managed/owned by the college administration and academic staff and/or under the control of the operators of Setanta College, in addition to the payment of any fee or charge, I do hereby waive, release and forever discharge Setanta College and its organisers from any and all responsibilities or liability for injuries resulting from my participation of activities or use of the above equipment during a practical teaching or assessment day.

7.2 I understand and am aware that strength, flexibility and aerobic exercise, including the use of equipment, in the outdoors, or assigned training areas, are potentially hazardous activities. I also understand that exercise and fitness activities involve a risk of injury and even death, and I am voluntarily participating in these activities and using equipment and facilities with the knowledge of the dangers involved. I hereby agree to expressly assume and accept all and any risks of injury or death.

7.3 I am aware that I have the right to request advice from all Setanta College lecturing staff, in relation to the activities and exercise being undertaken with particular regard to my health and clothing. If I choose not to take advice or disregard any advice given, I do so voluntarily and accept liability for all resulting injuries and damage.

7.4 I acknowledge that I have either had a physical examination and have been given my doctors permission to participate, or that I have decided to participate in activity and utilisation of equipment and machinery in my activities. In addition, Setanta College and its organisers cannot accept responsibility for items lost during onsite teaching sessions.

7.5 I have read these programme conditions and accept the rules and regulations that are outlined. I hereby declare myself to be physically sound and healthy prior to participating in any practical teaching or assessment day. I also declare that I will not take part in any Setanta College practical teaching or assessment day under the influence of alcohol or other inebriating substances.

7.6 All workshops which require physical attendance are subject to government health guidelines. Setanta College reserves the right to postpone or cancel any workshop if government health guidelines need to be invoked. Alternative online delivery options may be offered and you will have the option of reattending the postponed workshop at a later stage during the programme.

7.7 Students must not attend any event if they are displaying or experiencing any symptoms of illness.

8.1 The College has protection of enrolled learner (PEL) arrangements in place for all relevant QQI validated courses in accordance with the Qualifications and Quality Assurance (Education and Training) Act 2012.

8.2 All Setanta College QQI accredited programmes of education and training of three months or longer duration are covered by arrangements under section 65 (4) of the qualifications and quality assurance (education and training) act 2012 whereby, in the event of the provider ceasing to provide the programme for any reason, enrolled learners may transfer to a similar programme at another provider, or, in the event that this is not practicable, the fees most recently paid will be refunded.

8.3 At Setanta College this is currently provided by Griffith College Dublin and ICHAS. This is subject to change by the college and any changes will be notified to students in due course as and when they arise.

8.4 Visit the QQI website to if you want to learn more about Protection of Enrolled Learners (PEL).

8.5 Currently there is tax relief on our QQI accredited programmes. It is the responsibility of the prospective student to check the details of the relevant tax relief scheme prior to enrolment in the College. Receipts are issued by Setanta College once payment has been received.

8.6 By accepting the Terms and Conditions for using our online application system, you confirm that Setanta College can share your contact details with QQI, other relevant government agencies and other relevant colleges in the case of Protection of Enrolled Learners (PEL) arrangements being invoked.
